  • The Company acknowledges that it is solely the Company’s responsibility to keep proper records regarding training, inspections, and accidents, and to maintain all required OSHA records and Material Safety Data Sheets. The Company acknowledges its responsibility to have and utilize a written safety program, to perform all necessary inspections and hazard assessments, and to train its employees on all appropriate safety issues. The Company acknowledges that it must appoint and train a competent safety person on all job sites, and that Safety Alliance LLC. will not function as that competent safety person.
  • The Company acknowledges its responsibility to read and understand all applicable OSHA, ANSI, and other industry safety and health standards, and to seek professional guidance if any standard is unclear.

Furthermore:

  • Audits/Inspections: Due to the constantly changing nature of government regulations, conditions, and the human factors involved, no safety audit can possibly reveal all conditions existing at the audit site that may lead to injury, property damage, or fines. Furthermore, no safety audit can possibly render an opinion on conditions existing at the inspection site before or after the performance of the audit.
  • Training: The purpose of training is to impart knowledge to the trainees. No amount or type of training is guaranteed to prevent an accident or injury. The effectiveness of training in reducing the risk of an accident or injury depends on a variety of factors, most of which are not in the control of Safety Alliance LLC.
  • Written Programs: The purpose of a written program is to set forth guidelines to be followed as the Company discharges its obligation to comply with all applicable safety and health standards and provide its employees with a safe job site. No safety and health program can ensure anyone’s safety, and the effectiveness of a safety and health program in reducing the risk of an accident or injury depends on a variety of factors, most of which are not in the control of Safety Alliance LLC.
  • Translations: The purpose of a translation from one language to another is to impart the substance of the original communication in another form. Translations do not impart the original communication exactly, as different languages express ideas differently. Translations do not alter the substance of the original communication, however, so inaccuracies in the original communication will be present in the translated communication.
  • Therefore, the Company and its owners, officers, director, employees, and representatives hereby agree to hold Safety Alliance and its owners, officers, directors, employees, and representatives harmless and release them from any liability arising out of, or related to, any work performed (including website information, products & preferred Partners) by Safety Alliance. This Agreement includes, but is not limited to, any claim in contact, tort, or otherwise, arising out of any condition or circumstance existing at the audit site before, during, or after any audit or work performed (including website) by Safety Alliance LLC. The Company also agrees to: (1) indemnify Safety Alliance and its owners, officers, directors, employees, and representatives for any liability to any person or entity arising out of any work performed for the Company by Safety Alliance LLC, and (2) reimburse Safety Alliance LLC and its owners, officers, directors, employees, and representatives for all costs and fees incurred in the defense of any and all claims or causes of action brought by any person in any forum, if a judgment against Safety Alliance LLC in such action would be subject to indemnification pursuant to this agreement.
